There are three (3) types of divorce in Mississippi:
- No fault where both parties agree on all issues: This is the least expensive and most amicable type of divorce. Both parties agree they want a divorce and they agree on all terms of the settlement. With guidance from your attorney this type of divorce can usually be handled quickly and without undue difficulty.
- No fault with some disputes: Here both parties agree they want the divorce, however some details may be in dispute. In this event the parties may agree to submit the disputed issues to a Judge for a legally binding decision.
- The third type of divorce is called an at-fault divorce: When you desire to divorce your spouse but he/she will not agree to the divorce, then you must prove in court that your spouse has broken the marriage contract, for one or more of the following reasons:
- Adultery
- Habitual cruel emotional or physical treatment or abuse
- Habitual drug use
- Habitual drunkenness
- Desertion
Other grounds may also be brought before the court. The fault case must be legally proven in court and presided over by a Judge.
