There are three (3) types of divorce in Mississippi:

  1. No fault where both parties agree on all issues: This is the least expensive and most amicable type of divorce. Both parties agree they want a divorce and they agree on all terms of the settlement. With guidance from your attorney this type of divorce can usually be handled quickly and without undue difficulty.
  2. No fault with some disputes: Here both parties agree they want the divorce, however some details may be in dispute. In this event the parties may agree to submit the disputed issues to a Judge for a legally binding decision.
  3. The third type of divorce is called an at-fault divorce: When you desire to divorce your spouse but he/she will not agree to the divorce, then you must prove in court that your spouse has broken the marriage contract, for one or more of the following reasons:
    • Adultery
    • Habitual cruel emotional or physical treatment or abuse
    • Habitual drug use
    • Habitual drunkenness
    • Desertion

Other grounds may also be brought before the court. The fault case must be legally proven in court and presided over by a Judge.
